Shipping Policy

  1. APPLICATION

This policy applies when you purchase anything (Items) from our [www.ptl-store.com] (Website). 

This policy operates in conjunction with our General Terms and Conditions which is available at our Website. 

‘Physique The Label’ means Physique The Label Pty Ltd ACN  674 479 899 (Physique The Label) and includes its related bodies corporate and associates as those terms are defined in the Corporations Act 2001 (Cth) and references to ‘you’ mean you. 

  1. CONFIRMATION OF YOUR ORDER

Once you have placed an order, you will receive an email confirmation of your order. You will receive a second notification email with tracking details upon dispatch of your order (see further details below). 

Your order cannot be amended or changed once the first confirmation email has been sent to you.

  1. DELIVERY
    1. Dispatch

We endeavour to dispatch your order within 1-3 business days, however during launches and sales periods (including but not limited to new product launches and promotional launches) the dispatch of your order may be delayed. 

We are not liable for you order once it has been dispatched. 

    1. Delivery within Australia 

Orders within an Australian address will be delivered via Aus Post. 

Please refer to sendle.com and auspost.com.au for estimates on delivery. 

    1. Delivery outside of Australia 

Orders outside of Australia may take between 7 - 30 business days to be delivered via sendle. 

If your order is being delivered to a non-residential address, please include the company name when completing your order. 

    1. Our note to you 

Please ensure you order is being delivered to an address that you will be in attendance, or where it is unlikely that your parcel can be intercepted by a third party. 

We are not liable for your order if your order has been accepted and or signed for on delivery by someone other than the person who placed the order. 

We are not liable for your order if you opt or request ‘Safe Drop’ of your order by Australia Post. 

    1. Delivery times may vary

We note that the above delivery times may vary, and any estimates provided are subject to stock availability and delays which are beyond our reasonable control (including but not limited to postal delays or by something beyond our reasonable control).

  1. COST OF SHIPPING

The cost of shipping will vary depending on your location of delivery. Shipping costs will be calculated when you check out. 

Please note that the costs of shipping are non-refundable. 

5. AUSTRALIAN CONSUMER LAW

This policy, which excludes or limits our liability, shall apply only to the extent permitted by law.  Provisions of the Australian Consumer Law, and other statutes from time to time in force in Australia may apply warranties or conditions or impose obligations upon us which cannot be excluded, restricted or modified or cannot be excluded, restricted or modified except to a limited extent. This policy shall be read and construed subject to any such statutory provisions. If any such statutory provisions apply, then to the extent to which we are entitled to do so, our, liability under those statutory provisions shall be limited to:

    1. replacement of Items or the provisions of equivalent Items; 
    2. payment of the cost of replacing the Items or of acquiring equivalent Items; or
    3. payment of the costs of repairing the Items; or
    4. repair of the Items; or
    5. refunding to you the costs of the Items in respect of the Items giving rise to the liability.

6. PRIVACY

In order for Physique The Label to process your order we may collect your personal information, such as your name or contact details, including postal and email address and telephone number. Collection of your personal information will be managed in accordance with our Privacy Policy which is available at our Website.

7. INCONSISTENCY

In the event of any inconsistencies between this policy, our General Terms and Conditions and any other document or policy, this policy will prevail.

8. VARTIATION

Physique The Label reserves its rights to vary this policy without prior notice to you. 

Returns and Refunds Policy

RETURNS AND REFUNDS POLICY
  1. RETURNS AND CHANGE OF MIND 

Physique The Label is happy to assist customers that wish to return or exchange Items purchased on our Website as follows. 

    1. Returns – quality and defects

Our Items come with guarantees that cannot be excluded under the Australian Consumer Law. 

You are entitled to a replacement or refund for a major failure and compensation for any other loss or damage that ought to have been reasonably foreseeable by us. 

You are also entitled to have the Items repaired or replaced if the Items fail to be of acceptable quality and the failure does not amount to a major failure. 

If there is a problem with the Items you have purchased from us, you can return them to us. Upon assessment, we will offer a refund or replacement if there is major problem with the Items.  We may offer a repair or replacement if the problem is not major.

You must provide us with the order number which will appear on the invoice you will receive via email after making a purchase (Online Order Number).  

    1. Returns – Change of mind 

We are not required to replace your product if you simply change your mind. However, if you are not happy with your product, we may, at our discretion, decide to refund, exchange or provide you with a store credit, providing the product is returned to us in its original new condition with proof of purchase. If you wish to return Items because you have changed your mind about your purchase, we may offer you a refund provided that:

      1. You return the Items within 30 days from the purchase date. After this period, you may not be entitled to a refund or exchange.
      2. You produce your produce your Online Order Number when returning the Items.
      3. The Items have not been used or damaged in any way including that:
        1. they are in the original packaging, including any accessories and original tags and packaging; and
        2. they are unworn, unwashed, unused and in its original condition.
      4. You agree to pay us the costs associated with the collection of the Items (whether we personally collect the Items or arrange a courier to do so) and an administration fee for processing the return. 

All change of mind refunds are issued at the discretion of Physique The Label.  We reserve the right to refuse a refund for a change of mind request if it does not comply with these conditions. 

A change of mind return does not apply to items that are sold by Physique The Label on sale. These items cannot be returned. 

    1. Return process 

If you wish to return the Items (for either product failure or change of mind), the following process is to be followed:

      1. in the first instance, you should contact us (via website "contact" form or email) and provide your Online Order Number, an explanation of the issue, and if possible, provide images (Claim). We will then try to assist you via email in respect of your Claim; and
      2. if your Claim is unable to be resolved by email and you are an Australian or International customer we will arrange for a free return label to be sent to you via email. Simply return your Items to us by taking your Items to your local post office with the free return label. Once your Items are received by us, we will undertake a thorough assessment and review. Following our review, we will determine whether it is appropriate to arrange a repair, replacement or refund of your Items as a result of the Claim, or alternatively decline the Claim and return the Items to you.

4. Returns period 

Consumer guarantees under the Australian Consumer Law are not limited by a defined time period and can vary from product to product depending on factors such as the nature of Items, price and statements made on packaging and labels. We assist you with further information about the warranty period for the product you return.

    1. Eligibility 

To be Eligible for a return under clauses 3.1 and 3.2: 

      1. for standard returns you must return the items within 30 days of receipt of your shipment (receipt of being the date of delivery or attempted delivery); 
      2. for change of mind returns you must return the items within 14 days of receipt of your shipment (receipt of being the date of delivery or attempted delivery);
      3. Items must be unworn (items with make-up or deodorant stains will be deemed to be worn), unwashed with tags attached and in its original packaging
